Modifications

Modifications are requests to the court to change a prior order. Modifications may be requested regarding issues such as:

Modifications can be made based on changed circumstances such as a change in income, cost of living, or a change in the needs of the child. Other changed circumstances can also be considered such as a new job, a new school, or a relocation case.

Child Support Modifications

Child support orders can be altered if it has been a minimum of three years since the original order was established, and the monthly child support amount changes by either:

  • A difference of at least 20% or $100 from the amount that would be ordered under the current child-support guidelines.
  • In the event of a significant and consequential change in circumstances.

Generally, when seeking a modification based on the latter criteria, the requesting party must provide evidence of changes such as the paying parent’s income, legal responsibility for additional children, alterations in insurance coverage, or adjustments in living arrangements.

Enforcement

An order of child support or child custody can be enforced by the court through wage garnishment or by other means. For example, the court can hold the parent in contempt of court for failing to comply with the order.
